United States Customs and Border Protection (“CBP”) may make a demand for marking and/or redelivery on CBP Form 4647. The demand will include action required by the importer (e.g., requiring the importer to return goods to CBP or destroy the property under CBP supervision within ninety (90) days). The failure to comply with such a demand will result in the assessment of liquidated damages in an amount equal to the value of the goods or, if the goods are restricted or prohibited, three (3) times the value of the goods. Our firm assists in complying with a Notice to Mark and/or Notice to Redeliver and if necessary file protests or petitions contesting the notice or liquidated damages respectively.
